The High Coirt on Monday summarily rejected a writ petition filed by a Supreme Court lawyer challenging the legality of 12th general election scheduled to be held on January 7.
The bench of justices Mustafa Zaman Islam and Md Atabullah passed the order after hearing the writ petition filed by lawyer Eunus Ali Akond.
Referring to Article 123 (4) of the constitution, Eunus submitted that five more months were still in hand for holding the national election.
Having referred to Article 123 (3) of the constitution, he said that the general election had to be held within 90 days after dissolving the parliament.
However, the EC announced the schedule for the election, setting the election date as January 7 next year, when the current parliament would not be dissolved.
Eunus also sought a directive to the Election Commission to reschedule the election as a main political party remained absent in the 12th parliamentary election procedure.
The voting date should be deferred if it wanted to participate in the election procedure, the lawyer said and added that, if otherwise, the election would not be participatory.
